Welcome to Buba ("the App"). These Terms of Use ("Terms") govern your access to and use of the Buba mobile application and related services provided by Lea AI, LLC ("Company," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Description of Service

Buba is a self-care and wellness application that provides guided exercises, journaling prompts, mood check-ins, and other wellness-related content. The App is intended for informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

3. Account Registration

You may be required to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information and to update it as necessary.

4. Subscriptions and Payments

• Certain features of the App may require a paid subscription.
• Subscription fees are billed through the Apple App Store or Google Play Store, depending on your platform.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's app store settings.
• Refunds are subject to the policies of the respective app store.

5. User Content

You may create content within the App, such as journal entries and check-in responses ("User Content"). You retain ownership of your User Content. By using the App, you grant us a limited license to process and store your User Content solely to provide and improve the service.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or networks.
• Use the App to distribute malware, spam, or harmful content.
• Create multiple accounts for fraudulent purposes.
• Resell, redistribute, or sublicense access to the App.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, illustrations, audio, characters (including "Buba"), and software, are the exclusive property of Lea AI, LLC and are protected by copyright, trademark, and other intellectual property laws.

8. Health Disclaimer

The App is not a medical device and does not provide medical advice. The content provided through the App is for general wellness purposes only. If you are experiencing a mental health crisis, please contact a licensed healthcare professional or call emergency services immediately. We are not liable for any decisions made based on the content of the App.

9. Limitation of Liability

To the fullest extent permitted by law, Lea AI, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, arising from your use of the App.

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

10. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

11. Indemnification

You agree to indemnify and hold harmless Lea AI, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Sections 7 through 11 shall survive any termination of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after such notification constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
